Welcome to Sardegna Blue Marine! These Terms of Service ("Terms") govern your access to and use of our website (currently ), including any content, functionality, and services offered on or through it, as well as your participation in our diving courses, excursions, and other marine activities. By accessing our website or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.
1. Service Description
Sardegna Blue Marine ("we", "us", "our") provides recreational scuba diving courses certified by PADI (Professional Association of Diving Instructors), guided dive excursions, snorkeling tours, dive equipment rental, and related marine services as described on our website and promotional materials. All services are subject to availability and prevailing conditions (e.g., weather).
2. Bookings, Payments, and Confirmations
2.1. Bookings: All bookings for courses, dives, or tours must be made through our official channels (website, email, phone, or in-person at our dive center). Bookings are subject to availability and are confirmed only upon receipt of full payment or a specified deposit, as indicated at the time of booking.
2.2. Payments: Payment can be made via methods specified by us, which may include credit/debit cards, bank transfers, or cash (in person). Prices are quoted in Euros (EUR) and are inclusive of VAT where applicable, unless stated otherwise. Prices are subject to change without prior notice, but confirmed bookings will be honored at the price agreed upon at the time of confirmation.
2.3. Confirmation: Upon successful booking and payment, you will receive a confirmation email detailing your booked services, dates, times, and other relevant information. It is your responsibility to review this confirmation and inform us immediately of any discrepancies.
3. Cancellations and Refunds
3.1. Cancellation by You:
- Cancellations made more than 48 hours before the scheduled start time of the activity/course: Full refund or option to reschedule, subject to availability.
- Cancellations made between 24 and 48 hours before the scheduled start time: 50% refund or option to reschedule, subject to availability and a rescheduling fee may apply.
- Cancellations made less than 24 hours before the scheduled start time, or no-shows: No refund will be issued.
- For PADI courses, once course materials (digital or physical) have been issued or accessed, the cost of these materials is non-refundable.
3.2. Cancellation by Us: Sardegna Blue Marine reserves the right to cancel or postpone any activity due to weather conditions, insufficient number of participants, equipment issues, safety concerns, or any other unforeseen circumstances. In such cases, we will offer you the option of a full refund or rescheduling to an alternative date/activity of equivalent value, subject to availability. We are not liable for any other expenses you may have incurred (e.g., travel, accommodation).
4. Participant Requirements and Responsibilities
4.1. Medical Fitness: All participants in scuba diving activities must be in good physical health and will be required to complete a PADI Medical Statement (or equivalent). If any questions on the medical form are answered "YES," a physician's approval will be required prior to any in-water activities. It is your responsibility to ensure you are medically fit to dive. Failure to disclose relevant medical conditions may result in refusal to participate without refund.
4.2. Age Requirements: Minimum age requirements apply for certain courses and activities as per PADI standards (e.g., 10 years for PADI Open Water Diver). Participants under 18 must have written consent from a parent or legal guardian.
4.3. Certification: For guided dives (non-course dives), participants must present valid proof of scuba certification from a recognized training agency appropriate for the planned dive.
4.4. Conduct: All participants are expected to behave responsibly, follow the instructions of our staff and instructors at all times, and respect the marine environment. We reserve the right to refuse participation to anyone deemed to be under the influence of alcohol or drugs, or whose conduct is disruptive or unsafe, without refund.
4.5. Equipment: You are responsible for any rented equipment during its use and will be charged for any loss or damage beyond normal wear and tear.
5. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Sardegna Blue Marine or its content suppliers and is protected by Italian and international copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of ahe material on our website without our prior written consent.
6. Limitation of Liability and Assumption of Risk
Participation in scuba diving, snorkeling, and boat travel involves inherent risks, including but not limited to injury, illness, property damage, or death. By participating in our activities, you acknowledge and voluntarily assume all such risks. Sardegna Blue Marine, its employees, agents, and instructors will not be liable for any personal injury, property damage, loss, or wrongful death incurred during participation in our activities, except where caused by our proven gross negligence or willful misconduct. You will be required to sign a liability release and assumption of risk agreement before participating in any in-water activities.
7. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Italy. Any legal suit, action, or proceeding arising out of, or related to, these Terms or our services shall be instituted exclusively in the competent courts of Sassari, Italy, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
8. Changes to Terms of Service
We reserve the right to modify or update these Terms at any time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the website and services thereafter. Your continued use of the website or our services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
